1. Website and Service Overview

This platform provides users with access to a range of educational services, including language learning and practice, through a subscription-based model. SpeakON retains the sole discretion to update, modify, enhance, suspend, or discontinue any aspect of the service, whether temporarily or permanently, at any time and without prior notice.

2. Responsible and Permissible Use

Your use of our online services is subject to the following conditions. By accessing or using our services, you agree not to engage in activities that are unlawful, prohibited by these Terms, or could harm our services or disrupt the experience of other users.

Specifically, you agree not to:

  • Engage in harmful or abusive behavior: Avoid any conduct that is threatening, harassing, defamatory, or otherwise abusive toward others.
  • Perform unauthorized activities: Refrain from spamming, phishing, or engaging in similar activities, whether internal or external.
  • Commit unlawful or unethical acts: Ensure that your actions comply with applicable laws and ethical standards and do not violate these Terms.
  • Tamper with our services: Do not attempt to hack, access restricted areas, or interfere with the functionality or security of our platform.
  • Exploit or replicate proprietary content: You may not decompile, reverse engineer, replicate, or attempt to copy our online services or underlying content without authorization.

We reserve the right to restrict or terminate access to users who violate these provisions.

When using the service, you are required to adhere to our 1.1 Community Guidelines and maintain a respectful and safe environment for all users.

2.1. Community Guidelines

SpeakON is a global community of language learners, aiming to create an environment where members can collaborate, learn, and grow together. These guidelines outline the standards all members must adhere to in order to be a part of this community. Please note that violations of these guidelines may result in appropriate action being taken.

2.2. Mutual Respect

The SpeakON community consists of individuals from diverse cultural backgrounds and varying levels of language proficiency. Since we are united by our passion for learning languages, it is essential to treat one another with respect. Approach others’ questions or opinions with curiosity and an open mind, and value their cultural backgrounds and perspectives.

2.3. Collaboration and Support

Learning a language is a challenging and time-consuming process. Support and encourage all members, from beginners to advanced learners. When responding to questions or addressing mistakes, offer kind and constructive feedback instead of criticism. Negative attitudes or mockery disrupt the community’s positive atmosphere and are not acceptable.

2.4. Respect for Linguistic Diversity

Languages often have regional variations in expressions, accents, and word usage. These differences enrich the language-learning experience. Approach conversations about regional differences with an open mind, embracing them as opportunities to learn and grow.

2.5. Safe Sharing of Information

SpeakON is committed to protecting the privacy of its members. Do not share or disclose personal information (such as phone numbers, addresses, age, or email addresses) in the community. Additionally, refrain from requesting or encouraging others to share their personal information. Any risks arising from oversharing are your own responsibility.

3. Eligibility

3.1. By creating and using an account on our platform, you agree to the following terms:
  • Age Requirement: You confirm that you are at least 18 years old. If you are under 18, a parent or legal guardian must create the account for you, and your access must be authorized by them.
  • Accurate Information: You commit to providing accurate, current, and complete information during the account creation process. You also acknowledge that maintaining multiple accounts without approval is prohibited.
  • Account Security: You are responsible for safeguarding your login credentials and ensuring they are not shared with unauthorized individuals. Reasonable steps must be taken to prevent any unauthorized access to your account.
  • Responsibility for Use: You accept full responsibility for all actions, costs, or claims arising from the use of your account, whether such use is authorized by you or not.
  • Communication Consent: You authorize us to contact you via the email address associated with your account for updates, notifications, and service-related communications. You acknowledge that it is your responsibility to keep your contact details accurate and up to date.

Non-compliance with these terms may result in the restriction, suspension, or termination of your account, at our sole discretion.

3.2. You may not use the Service if prohibited by applicable laws in your country or region.

6. Security

We are committed to maintaining the security of the online services we provide. However, we cannot guarantee the security of our systems, records, or your data.

Access to the SpeakON online services is dependent on third-party services, and a stable network connection and location services are required for optimal functionality. In cases where signal quality is compromised due to location or service provider issues, audio, video, and other features may not operate at their full capacity or may be unavailable. Should you have concerns regarding signal strength, we recommend contacting your network service provider directly.

Due to the reliance on third-party services, there may be occasional interruptions in access to SpeakON online services.

SpeakON disclaims any liability for computer viruses or technical issues that arise unintentionally or are beyond our control. We strongly advise that you ensure your device is equipped with up-to-date security software.

7. Limitation of Liability / Damages

To the fullest extent permitted by law, all conditions implied by statute, common law, equity, trade, custom, or practice are excluded, and we disclaim all liability for any indirect or consequential losses arising from the use of the SpeakON online services.

Nothing in these Terms and Conditions is intended to exclude, limit, or modify any consumer guarantees, rights, or remedies that may not be excluded, limited, or modified by law.

In the event that SpeakON’s liability cannot be legally excluded, our liability will be limited, at our discretion, to one of the following:

  • The provision of access to the SpeakON online services again, or
  • A refund of the amount paid by you for access to the SpeakON online services during the period in which the complaint or dispute arose.

The maximum aggregate liability of SpeakON for all proven losses, damages, and claims arising from or in connection with these Terms and Conditions, including any liability for breach, negligence, or tort, shall not exceed $100.

To the maximum extent permitted by applicable law, in no event shall SpeakON be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the access or use, or the inability to access or use, the service or any part thereof, whether for you or a third party making claims through you (under contract, tort, strict liability, or any other theory). This includes, but is not limited to, damages from service unavailability, inaccurate results, loss of profits, business interruption, or loss or corruption of data. Additionally, damages related to the recovery of inaccurate data, costs of alternative services, or claims by third parties for damages to their computer, software, modem, phone, or other property (even if SpeakON was notified of the possibility of such damages) are also excluded.

To the maximum extent permitted by applicable law, SpeakON’s liability, for any reason whatsoever and regardless of the form of action, shall be limited to the amount paid by you for the service in the 12 months preceding the event that caused the liability. This is the total liability limit, which does not increase even if there are multiple claims.

You acknowledge and agree that the pricing under these terms was set with the understanding that the liability limitations outlined herein are fundamental to the risk-sharing arrangement between the parties and form the basis of the transaction.

8. Payment Processors
